Man wins large jury award in premises liability case

Large and diversified businesses such as retail department stores and discount outlets have an above-average responsibility to their customers. These stores may contain hazards such as wet surfaces and products left in walking paths. Either of these can cause a fall and serious injury.

Businesses and their managers are often considered negligent if these hazards are present after a reasonable maintenance sweep would have discovered them. Victims of slip-and-fall accidents may sue responsible parties for financial damages to cover medical expenses and other related costs.

A Broward County jury decided in favor of a truck driver when he sued a local branch of a large retail chain. The man claimed he slipped in the plants department, injuring his knee and suffering herniated discs in his back.

The suit included claims for future medical expenses as well as the initial treatment and recovery costs. The truck driver's doctor testified to the costs of a potential knee replacement surgery in the future. After less than an hour, the jury awarded the plaintiff nearly $1 million in total damages.

This result comes after a 2015 case in which a Florida woman reportedly slipped and fell at one of the chain's Orange County locations in 2013. She said she slipped on a foreign substance due to the store's failure to clean the floors properly.
