Florida appellate ruling reversed motorcycle crash ruling

Motorcycles are one of the most exciting ways to enjoy the American road, and Florida leads the country in motorcycle riders and opportunities for good rides. The spirit of the chase can get out of hand, and a legal battle over the circumstances of one ride continues to unfold in a Florida court.

The Fourth District Court of Florida reversed a previous ruling on a personal injury suit involving a motorcycle crash, remanding the case back to the earlier court for trial. Excluded evidence and differing versions of the crash's beginnings and aftermath led the court to side with the defendant during his appeal.

The plaintiffs alleged that the defendant stopped next to their motorcycles and gunned his engine. Although this point is uncontested, they continue to say a street race began and the car driver swerved to knock one motorcycle into the other. The driver denies this.

The critical point for the ruling was the possibility that the motorcycle riders were intoxicated and riding with a license violation, as well as an excluded witness statement that may have cleared up the different versions of the event. Included testimony also created "similarly inconsistent" records, according to the appellate court opinion.

Motorcycle safety is the responsibility of everyone on the road. Careless driving, inattentive motor vehicle operators and substances such as alcohol and drugs can turn a simple ride into a crash scene. Extra care and sobriety is required to prevent injuries, permanent disability or death, as well as the legal issues surrounding motor vehicle collisions.
