Military divorce presents complex situations

Even in the most optimistic of scenarios, divorce can be a complicated and anxious time for the splitting spouses. They have to deal with property division. They have to manage other legal issues, such as their estate plans and other legal considerations that were tied into their marriage. And most importantly, they have to manage themselves. They have to deal and cope with the emotional fallout from a divorce.

But as difficult as the process can be for any divorcing couple, think about how complicated it is for a couple that has one military member - or has two military members. Military divorce inherently involves a number of issues that you would not see in any other divorce.

For example, consider the location of the spouses. Depending on what their current status is with the military, they could be stationed in a different state, in a different country, or be on a naval vessel. This inherently makes the divorce process more difficult. Communication could be nearly impossible, and thus completing the necessary legal steps is hard.

Another example is with benefits and financial considerations. There are a number of financial benefits that military members get as a part of their service. These benefits may be linked to the military member's spouse - so with a divorce, these can be contentious issues.

For our military members out there who are considering divorce or are caught up in a divorce right now, you should consult with an attorney that has experience handling military divorce.
