Former NFL player Kordell Stewart files for divorce

Tampa residents who are contemplating divorce may be wary of asset division. We've all heard stories involving bitter divorces that result in one spouse taking another to the "cleaners". However, we've also seen spouses amicably split their assets. Deciding whether to divorce can be one of the most difficult decisions you will have to make, and many times, the decision will have a lasting financial implication.

Former NFL player Kordell Stewart has filed for divorce from his wife Porsha Williams. Prior to their marriage, the couple publically stated that they did not believe in prenuptial agreements, and therefore did not draft one. Now, it would seem that Stewart has changed his tune considerably. Stewart is asking that Williams not be awarded alimony or her share of the marital assets because Williams earns an income, is able-bodied and capable of supporting herself. Williams is known for her role on Real Housewives, where many viewers believed Stewart was highly controlling of his wife. The couple do not have any children together, and were married in May of 2011.

For many contemplating divorce, the idea of sorting through assets may seem overwhelming both emotionally and financially. While dividing a record collection can be painful, figuring out who will keep the house, car, or 401(k)s can quickly make the idea of asset division entirely excruciating. After all, the things accrued or collected during your marriage are reminders of good times and sometimes the fruition of your collective dreams.

In Florida, if you are not able to divide property amicably, a court will evaluate your situation and equitably distribute your assets. Florida is an equitable distribution jurisdiction which means that a judge will determine what is fair, rather than dividing the property down the middle. A court will also determine what property is categorized as community property, separate property or property purchased with comingled funds.
