Ex-NFL star Warren Sapp seeks to modify child support

Florida parents having trouble paying their child support payments understand the system can be frustrating and emotionally difficult. Given the nature of the current economy, many parents are finding that a child support modification is necessary.

Recently, football star Warren Sapp filed legal paperwork in Florida asking the court to modify child support payments owed to one of the mothers of his children. Sapp is seeking to lower payments for his other four children as well. Currently, the ex-NFL player is paying $2,500 a month. Since falling on difficult times, which resulted in his bankruptcy, Sapp is looking to lower his monthly payments.

However, a clause written by Sapp may make the modification unlikely. The clause allegedly stated that neither party would be able to seek modification based upon a change in income. Sapp was likely attempting to protect his income, which at the time of the contract, was worth millions.

Legally speaking, there are certain circumstances where a court will modify a child support arrangement. The payments can be modified to either increase or decrease a child support payment, given the particular situation. Typically, a modification will be considered if a large life event occurs, making it necessary for a modification to occur. Such events can include serious injury, job loss, or a change in income or marital status. Child support payments are not dischargeable in bankruptcy.

If you find a modification is necessary, it is important to take action quickly in order to secure a modification. If your relationship is amicable, you can attempt to revise your payments with the other parent of your child. Unfortunately, many times this is not the case, and the assistance of the court is needed.

Losing a job or an unexpected life event may make child support payments impossible to keep up with. In the time until your court date, continue to make payments to the best of your financial ability.
