Kardashian-Humphries: short marriage, long divorce

Tampa residents who are going through or contemplating a divorce may feel overwhelmed with the potential timeline. While the lengths of divorce proceedings may vary, some can prove to be truly exhausting, and take a great amount of time - particularly in high asset divorces.

Most are acquainted with the notorious marriage of Kim Kardashian and Kris Humphries - a marriage that received much criticism for its 72-day lifespan. While the marriage was over in a blink of an eye, the same cannot be said for the divorce. Recently, the one-year mark has passed since Kardashian filed for divorce. While both parties perhaps optimistically believed the divorce would be cut and dried, it has proved to be both arduous and lengthy.

There can be many reasons that a divorce can take a long time to become final. In this case, Humphries allegedly wants to show the court that the marriage was invalid, and that both he and Kardashian entered into the marriage with full intentions of exiting it. If he can prove these allegations, the prenuptial agreement also would be void, thus allowing Humphries to attempt to claim a piece of the Kardashian wealth. On the other hand, Kardashian contests the allegation, adamantly claiming the marriage was entered into with nothing but love. As a result, the divorce slowly creeps onward, with depositions, new allegations and a large amount of media attention.

Legally speaking, the quickest and perhaps most pain-free method of divorce is to agree to divide the property amicably between the spouses. However, as illustrated in the circumstances above between a high-profile couple, this does not always occur. When a couple is unable to amicably divide the property between themselves, a court will step in to evaluate how best to divide the assets.

In Florida, property is divided through equitable distribution. Rather than dividing the property in half, as is the case with most property division laws in other states, a judge in an equitable distribution jurisdiction will determine what is fair under the circumstances and divide property accordingly. A court will calculate the total value of the marital estate, and then based upon various factors examined under equitable distribution, award each spouse a percentage of that estate.

It is important to remember that while some divorces can get bogged down in allegations and notoriety as in the Kardashian union, others can move very quickly and efficiently. Divorce is never a pretty thing, but with proper legal assistance and support from friends and family it can close one chapter and allow for the next one to begin.
