Judge puts the heat on Heat star's wife in custody dispute, p. 2

The Tom Cruise/Katie Holmes divorce has pushed Miami Heat star Dwyane Wade's family court issues right off the front page of celebrity tabloids. The custody and visitation argument is still very much alive for Wade's two boys, though; a handoff that did not go as planned landed Wade and his ex-wife, Siohvaughn Funches-Wade, in a courtroom recently, with their 10- and 5-year-old sons stuck right in the middle.

As we discussed in the last post, the couple had agreed, with the help of a mediator, that Wade's sister would pick the boys up at their mother's house to take them to the airport, where they would hop on a plane headed for Miami. The handoff went seriously wrong, ending eight hours after the appointed time and resulting in Funches-Wade's arrest.

Wade petitioned the court to modify or to suspend outright his ex-wife's visitation privileges. The court heard testimony from several witnesses, though Funches-Wade was not among them. Wade himself did not attend the hearing.

The judge decided that the best interest of the children would be served by having them stay full-time with Wade in Florida for the time being. At the end of the hearing, the judge ordered Funches-Wade to shift the location of her visits to Florida while the court considers the petition. Wade has sole custody, but the boys shuttle back and forth between his Florida home and his and their mother's homes in Chicago.

The pending criminal charges against Funches-Wade complicate the temporary visitation modification. By law, Funches-Wade is not allowed to leave the Chicago area. The family court judge agreed to ask the criminal court judge for an exception.

Because Wade has sole custody, and because the children will live with him full-time, he has also petitioned to involve the Florida courts in the custody and visitation dispute. The status of that request is unknown at this time.
